Is it possible that he is just using your pictures because he doesn't have a digital camera or something? I think I am gouing to start putting captions right on the photos I take to prevent people from claiming the work is theirs, it seems to be happening more and more.

Na man your mistaken,
Either remove those pics(disposable cams are cheap man), or i'm emailing ebay about this.
For a seller to borrow an image of a product, that is not of the actual product for sale, may be viewed as a dishonest representation.
