OT / Vacation Pay question

I will be seeking profession knowledge on this so don't tell me to do so.

Situation.

We got paid this friday. Cut off is sunday past.

Pay periode was from Monday the 20th to Sunday the 5th.

That monday was a Alberta holiday. We did not work and got paid for 8hrs.

We work that first satuday which was the same week as the holiday.
Next week we did not work OT.

So some people had 88hrs Regular pay.

Thoery was that since we din't "work" 48 hrs and actually only work 40 + 8hr vac. That saturday was regular time.

There were some pissed off people on Payday.

And to make matters worse we had worked the satuday before that holiday therefor it wasn't even a 3 day weekend.

I personally believe that is the way it is legally but still...

BTW We pay OT after 40hrs not 44.

Seems logical to me. I don't know what there is to complain about. Its not as if people actually worked that stat holiday.

That has nothing to do with what we are talking about.

But thank you for your need to post.

"Theory was that since we din't "work" 48 hrs and actually only work 40 + 8hr vac. That saturday was regular time."

If you have only worked 40 hours, there is no overtime due. A stat holiday is pay that you get whether you work or not, it does not constitute any regular hours. If you had worked that monday as well, then that would have given you 48 hours of normal time + the stat. Then you would have been able to claim OT.

OT is also due for hours in excess of 8 hours in a day (unless a bargaining arrangement is in place), double time in excess of 12 hours in a day. (again unless a bargaining arrangement is in place).

There are exceptions to this, if you are management or a salaried employee for example. This may also vary from province to province.

yeah that doesn't seem right but in theory like you said you didn't work 48 hrs. you should come up here if you want overtime. 4 10's mon-thur,,,fri is time and a half, and sat and sun are double time!!! nothing beats a dollar a minute on the weekends!!! plus you get paid every thursday. but income tax hits hard, almost a grand a week.

^ Agreed. Many places that have computer generated pay stubs keep holiday, vacation pay, and overtime pay separate from the standard pay for this very reason - so people don't get confused over what was actual worked time and what is a holiday 'bonus'.
