5km/h Speeding Ticket

C'mon guys, is this BS? I thoguht the minimum was 10km/h over for a ticket, and even then there are no points associated with it. I was going 65 in a 60.

In driving school, 6 years ago, they told me that there is a gray area +-5km/h, because no person is capable of going 60 in a 60, for extended periods of time.

$12.50, fine, $15 surcharge. $27.50 total. LESS than a damn parking ticket, which is why I want to fight it. And of course for spite...

I'm 21 btw, so if I did pay it, it would drop off in time for my 25th birthday insurance drop. But its more of a spite thing. What the hell is 5km/h over? I have not received a ticket in years. It's like paying a fine for burning ants.

On top of that, my 10km/h over ticket 2 years ago was placed on my abstract so am I to assume that this will also be on there, thereby affecting my insurance?

Vehicle speedometers are not built to be extremely accurate, they have a margin of error, just like guages, they also are not designed to be exact, only an indication of what is going on. The more expensive the guage, the more accurate it will be.

There can be up to a 10% error factor in a speedometer, especially at higher speeds. Tire wear, friction, component wear etc can all play factors in speedometer accuracy.

Fight it!

I live around morningside/kingston. I was comming off the highway and took the kingston exit which is 80km/h, but then it turns right to 60 as soon as u go under a bridge. Cops always way right there, because apparently we are supposed to change speed instantaneously.

Bullcrap.

check this forum: http://www.ontariohighwaytrafficact.com/ (can't post a URL due to this forum rules, I'm below 5 posts, sorry)

65 is over 60, so you were speeding (driving over the speed limit). just like when driver's level of alcohol in blood is over the limit, then the driver is intoxicated and committing DUI.

i know, 5 over is BS. check that forum for more help.

if you decide to fight it in court (which is recommended), your only line of defense should not be the hope the officer will not show up. If he bothered to give you a ticket for driving 5 over the limit, do you think he will go to court?

your speeding offense will most likely affect your drivers insurance. try to get the ticket converted into something that will not affect the insurance, like failure to provide registration or something. i don't know exactly, research in the other forum.

btw, was your system playing loud at that time?

I'd tell the judge that I'm a good driver with no prior tickets and don't deserve this ! chances are they will let you off.. everyone gets something if you show up in court..

FYI the way they work it is everyone fighting a ticket that cop wrote will appear the same day... unless no one else is fighting a ticket that cop wrote in the last three monthes, chances are he is going to be there...

but there is a prior ticket.

you could argue that it is not possible to slow down to 60 in time with the given sign placement, but since you know that spot already, that will most likely not work.
