Well a friend of mine got into a major accident in Calgary on February 20th, 2005.

Here is the before photo of his 2001 VW GTi Staged 2 turbo.


Here is the after.


He was injured quite badly. He was in a coma for 3 months, and is still off work and any other leisure activities. He now is being charged for Unlawfully operating a vehicle. He does not know what to expect to happen. Will he be fined? Lose his license? He doesnt know. If anyone could help me out, so he knows what to expect, and not worry, that would be awsome. Thanks very much guys.

He is now recovering, and doing good [img]smile.gif[/img] . He was apparently in a 50 km/h zone, and was doing 100km/h +. They tried to check the car computer, but he had a performance chip in, so they could not do it.

Unlawfully operating a motor vehicle just means that he did something illegal while he was driving. He needs to find out the specific charge. I'm assuming that they have reasonable evidence to charge your friend with dangerous (reckless) driving, which if I remember correctly is a Canadian Criminal Code offence. I just did a quick search and came up with this:


249. (1) Every one commits an offence who operates

(a) a motor vehicle in a manner that is dangerous to the public, having regard to all the circumstances, including the nature, condition and use of the place at which the motor vehicle is being operated and the amount of traffic that at the time is or might reasonably be expected to be at that place;
(2) Every one who commits an offence under subsection (1)

(a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years; or

(b) is guilty of an offence punishable on summary conviction.

He was doing 100+ because the signs were covered in mud, and he was coming off of a highway. His mother took pictures right after the accident. After his accident, they also re did the whole area, and changed the roads, and signs.

Happy to hear he's recovering but if that is an excuse as to why he why going so fast it is poor.
50km/h zones don't look like the 401. Signs or not.

While I'm trying to have some compassion for your friend, I'm thinking he's probably screwed.

You know as soon as a judge hears "Stage 2 turbo + performance chip" he's not going to think you're buddy was out for a leisurely drive.

He was out having fun with his car that had been upgraded to do nothing but make him go FAST. (btw, that's one hell of a nice car [img]graemlins/thumb.gif[/img] )

I'm no lawyer, but I think he's in big trouble.

Out of curiosity.... with his performance upgrades, did he also upgrade the brakes? A lot of people don't bother with them because they just want to sink their cash in to going fast.
