Someone crashed my car!

Angry Someone crashed my car!

Okay, so I have a serious problem, and I am certain that this is the best (only) place to get any proper help.

Well, the person in question claimed that he/she was cold since we were outside at a park, and asked if he/she could sit in my car to get warm. Being a curtious person, I gave this individual my keys. When I returned to the parking lot, my car was gone. Moments later, I get a phone call that my vehicle has been crashed.

Looking at the loss (only on one side) - the skirts, bottom portion of the door, and the rims were damaged, while the two tires on that side were completely flat. Apparently, the person went over a large rock, which caused the damage. This individual does not have a license so she would undoubtedly have faced criminal charges, and hence, I approached the person's father. The father wrote a note claiming that he would cover all costs, but by looking at him, I highly doubt he'll be able to. I also recorded the conversation we had on my cell phone.

I am scared that my axle might be damaged, which from what I have heard, might translate to the car being beyond repair. More significantly, I am worried that the father will not be able to pay for the repairs if the damage is really this serious.

I am sorry for the long read, but what do you guys think is my standing at this point, with the recovery of the funds for repairs and the possibility of the axle being impacted? I haven't called the cops, but having a written document and a recorded conversation, will I be able to in the future if I do not recover my losses?

This just happened a few hours back, and any help would be great.

You have one intelligent option but I will write them both out anyways.

1. You like this girl enough to take the chance of getting stuck with all repairs bills for your vehicle. (not smart. Try to pick a woman that won't take your car for a joyride next time).

2. File a police report ASAP.

Should I wait till Monday since that is when we expect to get a quote, or would it be wiser to go ahead and file a report tomorrow morning?

No, you file the report now. If the local Police detachment tells you to come in tomorrow or the next day, whatever they decide, then follow their instructions. As this is not an emergency, call the non-emergency phone number.

Right now you have given this girl an out, don't be surprised if she takes it and leaves you holding the bag.

Is it true that I have up to three days to file a report after the accident has occured?
I think I will wait for some more respones, since I cannot do anything at 2am in any case.

I don't know how long you guys have in Canada to file, but yes, do it ASAP. Like said before, she sure isn't going to pay for it, and if you don't think her father can then he probably can't. So file the report!

Sorry to hear about your loss, I too had someone crash my car. It would be nice for this person to pay you, but don't hold your breath. Do they even have a job? What I learned from my experience is never let someone drive your car without a valid license. From what my insurance agent told me it's even better if they have their own insurance that way your insurance sues theirs for the damage. No matter what your insurance will repair all damage if you have full coverage. I believe to have your car repaired from an accident if the damage is over one thousand you have to file a police report anyway.

You can claim it on your insurance for up to a year! Tho I'd double check with them if you were considering to do nothing for awhile.

FILE THE REPORT ASAP!!!!!
Any sort of gap between the accident and the report or claim makes it that much harder to solve any sort of problem. I myself would press charges and do what ever is needed to get my car fixed.

That's the thing though, she never had my consent to drive the car.
The keys were given to her so that she could go to the car and warm herself up.
I would never have given her, on anyone there, permission to drive my car - I am certain she knew that.
I will file a report tomorrow morning, hopefully it isn't too late.
