Well I need some opinions please.

I've purchased something off of a user on this board. (those of you who have a good memory will know who)

It's been over 2 months now that he's had my cash and I have no product. It was supposed to be at my house within 3-4 days.

Since then I've been in contact with him twice. 1st time he said it was because his PC got a virus and he needed my address again. 2nd time he said he was waiting on a part, but he now had it, and would ship it out by the end of the week.

It's been over a month now and I haven't heard jack squat from him. I've tried sending PM's but they go undread. I tried calling but I got no call back, or even an email. (gave either option in case he doesn't feel comfortable calling me)

Hell, I've even tried contacting people that I know are local to him and have them ask him to call me but still had no success.

So should I keep waiting or should I say 'enough is enough' and do something about it?

If it's time to do something about it, what should I do? Contact his local police department?

I still have all of the PM's saved and there are apparently a few others on here that are waiting for items as well, so would getting their info also help?

I'm getting frustrated as hell. Any opinions would be great.

i also noticed that that particular member you are talking about has stopped posting on this forum in the last month or two. However he attends and competes in the shows that are posted on this forum, so we know he read it.

I say u start off by posting some bad feedback on here and if that doesnt work you shall warn that individual of your intentions to begin legal action.

Small claims court is the only legal recourse I believe.. depending on the cost of the object, it might be more expensive.. my suit against someone who borrowed money off of me cost me $75 to get going if I remember.. and I made her pay for half of it.. but I still got my money back in the long run.

The only problem I see here is if you are from out of province.. I am not sure how that is taken care of. Good luck!!

Yeah i woudl start posting bad feedback on this forum and a few others if you know he frequents them.

I would of done that after one month... especially since he hasnt been getting back to you.

Start out by saying who it is on this thread, then make an official post with his user name in the title.

Well I feel very badly about having to do this, but I guess I might as well help anyone else that may want to deal with this person in the future.

The member in question is Rob V.O. (aka LoudBrownKickerColt)

For now I would really have to suggest that no one here does any business with him because he doesn't seem to be able to deliver.

I inquired about an alternator from this guy as well and the response just did not sit well with me. Glad I took the wait and see approach. Small Claims action is cheap and easy and 99% of the time will get a satisfactory result.

Hrm.. that's funny because I always got a good impression from him.

There are even other users on this board who had purchased from him and had no problems.

Ahwell... I REALLY don't want to have to go to court over this. Even if he pays every last penny, it's still a huge hassle.

Might not have a choice though.

Just pay the dollars for the actions and have a process server deliver the forms if you do not want to make the road trip, this will get his attention right away. As was pointed out above, he is on the hook for the dollars associated to the costs of filing the claim and for the process server. He may pay up right away and / or send your equipment right away, but at this point in time, the claim has been processed, all you need to do is wait like you have been. If he has not payed by the time that your court date has been set, the judge will more than likely rule in your favour and if he does not show up, he can issue a seize order on bank accounts, possessions etc.

With him not shipping any product and no refunds being given it is more than likely an arrest warrant will be issued for fraud or theft under. This can lead to a criminal code conviction and this will be the end of life as this guy knows it. Business is business, don't let any personal feelings get in the way of this. You have been patient and now the time has worn out. You do not want to wait too long to pursue this, one thing the judge might ask you is "why did you take so long" to which you must reply.

No offence intended to him if he reads this but if you play someone like this, chances are that they will play someone else as well, maybe they are not members on the forum and we'll never know. Don't let this slide dude, get on it. It is cheap to do, does not take much time and will guarantee results.
