Speeding Ticket
I received a Speeding ticket in Vancouver. two issues here: 1-the Officer did not record my full name. I do have a middle name on my BC Driver's Licence, and there are at least 8 other men with the exact first and last name. My name is in the white valid section. Does that make the Ticket invalid?
2-the Officer said if I signed the ticket at that moment, I was admitting my guilt, the Fine would be reduced from $195 to $138, and if I paid within 30 days another $25 would be deducted. Did I admit my guilt when signing?
I was extremely polite, and did mention I was a professional Bus Driver.

113 isn't so bad. Think about what'll happen when you try to argue it in court, you're guilty, aren't you? They don't need to get all the people with those names. Are you going to say that it wasn't you and it was one of those other guys with the same name and different vehicles? That's exactly what they'll say. Don't try to play it off as a technicality, you'll seem retarded, and you want to keep your licence.

If you understood it and signed, now you're getting theoretical. Can they ask you to admit your crime for less money? Of course, they don't care. They probably have that system because when people actually fight the ticket, they win. You think your government is paying you to be honest? NO! You could tell the court you couldn't pay your bills without accepting the lesser fine, but how likely is it that you'd win anyways? You're a "professional" (not exactly a career?) bus driver speeding no less and you don't know about your driving laws?

1) No the ticket will not be invalid. Your DL# number is also recorded on the ticket and the entire ticket will be entered into PIRS and PRIME. There will be no doubting the officers ability to prove who is who if challenged.
2) I am going to guess this was VPD and not RCMP. VPD may have a slightly different set of guidelines under the motor vehicle act but I highly doubt it. If he worded it to you that your signature is an admission of guilt to save some $, sign the ticket and move on with life.
Professional driver or not, you provided the officer with the opportunity to pull you over. If you are a professional driver and a ticket on your driver abstract is a detriment, you knew about this at the start of your career. Why would you provide the opportunity to the police to give you a ticket in the first place? Not a very professional move at all if you ask me. Being polite, definitely a professional move and always in your best interest.

I would dispute it.. It will take over a year {most of the time} I have 4 in dispute right now.. And the chances of the cop being trancferd befroe the court date are vary good.
I have a court date for Oct 2009 and the tickit was issues Sept 2008

Again, the RCMP and VPD are two totally different organizations, what is policy for one may not be for the other. You have the legal right to dispute your tickets, but to dispute them on the basis of the officer not showing up..... well, the officer if transferred does not necessarily have to show up anymore. The officer is off that day of court lets say (as all detachements operate on different schedules due to staffing - here it is 4 on 4 off, 2 days, 2 nights), if it falls on the officers day off, it is OT and that officer will be showing up for sure. The chances of the officer being transferred are actually very slim, it is cost prohibitive to move people and families around now. VPD, where would you transfer to exactly.....
If you have legal grounds to dispute something that is one thing, to dispute it juse because you can though, be prepared for the judge to also increase the fine, impound a vehicle, impose restrictions, remove your license...... if you can do something, so can the court..... choose wisely.

I agree pay the fine, its a cheap one and it saves the headache and hassle of pursuing it!
Tommie, disputing 4 tickets is dumb obviousely you deserved them if they keep stock piling like that, I would know as I have had about 14 since getting my license, so about 11years ago! It is very possible to win the battles in court and not near as hard as you might think, but its just a big waste of time, just pay the fine and be happy it was a cheap one

I got one at midnight on a pitch black road.. The cop said that I wasn't wearing my seat belt... How the Hell did she see Up into my truck in the black night... And they are always near the end of the month... Trying to meet the quota???
