First thing to do is contact the RCMP and have a file opened. A investigation will take place and perhaps this is the guy who has been ripping off other people on many forums for the last couple of years, who knows. Next step is small claims court and he would then have to make the trip to Alberta. He doesn't show, the judge can and will order anything from a forfeiture of funds from his bank account to an arrest warrant.

he is right. the RCMP aren't just going to issue an arrest warrant because some guy may or may not have paid a buyer back... Not saying that the complaints in this thread aren't 100% true, just that the RCMP can't do that. they need proof of theft, which is very hard, as well for the amount this small it's off to small claims for it... that's the best solution you have.

The cops aren't, and can't really do anything about it.

That's not even close to being accurate. f
irst thing, the dude can petition for the location to be moved to a court in his town, with good reason. secondly, that's not the way small claims court works. Once you win the case (if) the guy who ripped him off will be told what he has to do, as in how much Audio rookie was awarded. then Audio rookie has to chase the guy to get his money. if it takes forever to get the money out of the guy, then Audio rookie has to take him back to court to get a judgement against the guy to garnish wages, can't touch the bank account... this is a long process, and if the guy is smart enough he can dick around for months if not longer before you see a dime, meanwhile you are still out the money...

True, I have spoken with my aunt (works for a big lawfirm) and she has told me a few ways to make it a little quicker....but I could still waste 6+ months...but hey, I have already wasted that much time.

Meanwhile I will be phoning him all the time from different places and bugging the out of him.

That ****ing liar gotta pay up. I will not put this to rest no amtter how long it takes.

it takes time, but that's the best way to go about it... one thing though, this may offend people here, but your best bet (it seems you figured this out) is to not take law advice from a forum... it seems like your in the right direction, good luck.

So as a business owner with delinquent accounts, if what I posted is inaccurate, how did I get my guarnishee orders for two accounts? I think I know more than enough of what I am talking about here. Now what I mention may take place in BC and the laws may be different in other provinces, the overall process is more than likely going to be highly similar. Long story short though, you should have taken care of this when you first posted about it. Good luck with the collection process and post the results.
