Problem is poopy encoders. You can have poop 320s and good 192
Look for OGG and AAC. They're inherently better and people that use them are competant.
With MP3, every idiot with MusicMatch can compress them with whatever quality they choose.
Try to download 320's exclusively and hope for the best.

here's a test... get a tone generator... generate a 15 or 20Hz tone... should generate into a wav file...
Make a copy of it, and covert one to 128 kbps MP3... burn then onto a CD and play them through your system, if your system can handle that low of a frequency. YOU WILL hear a difference.
This is just an extreme example, most music does not play down this low, but experiment with different tones, and different compressions ... listen carefully, difference are audible...

The only thing it does that's kindof a pissoff, it installs weathercast and Save. weathercast is easy to remove just go into your add/remove programs in the control pannel and get rid of it, save I usually just run MSCONFIG, remove it from startup, and then delete the directory in program files.
Once you get that out of the way, all is good! Oh and one other thing thats a good idea, when you start running it for the first time, go into options and shut off your uploading and set it so no one can see your files, and in the downloads crank it up if you have a good high speed connection. Set it to download like 30 files at once with up too 1000 connections per file kindof deal.
It may sound like a pain in the ***, but once you have it setup (within 10min) you just fire it up, and find your songs! I very rarely can't find a song I'm looking for. Plus there is alot of **** you can download... so i'm told...

another vote that bitrate, while important, is no more important than codex used to code the mp3. now this is going off memory from a couple years ago, so bear with any mistakes, but generally most mp3 files at 128kb have filters that reduce frequencies above 18khz and below ~20hz to help with compression. which attributes to the muddiness you hear with it.
also, most mp3's are coded fbr (fixed bit rate) it's good generally, but on songs where for example you have all frequencies of the audio scale being played at once, the mp3 compression can't handle it and sacrifices are made. it's like pictures that don't compress well because zillions of different colors and shades vs pics that have a lot of the same color tones. except with mp3 you're forcefeeding the compression into that bitrate and it can't keep up. the fix is to use vbr (variable bit rate) where the bitrate the song is coded in will change depending on the demand of the song. it results in larger file sizes, but improved quality...
for codex, i'm in favor of LAME. nothing out there has the options and quality of this codex (or did as of 2002)
for quality purposes, a 192kb vbr LAME encoded song with a full frequency spectrum is full CD quality in all blind listening tests done on it. otherwise, 256 kb fbr with a good codex will generally get you CD quality too...

I have heard some lame attempts to encode a song at 320, and on the opposite have heard some mint 128 copies that used a good codec.
I prefer Fraunhaufer (sp)
I dont know if its changed or not but at the time it was some good stuff.

you can hear the compresion in 128, i dont care what codac you ripped it with
some people have burned cds with mp3s encoded at 320, then re pripped them at 320, allthough the bit rate is 320, the size is that of a song riped at 320, it sounds like a lesser rip because it has been compresed twice
also a lot of people do radio or tv rips, they belive that a high bit rate will help compansate for the original low quality of the sorce
