Repo'ing or Repairing a Car??
Does anyone know the legal procedure for repoing a car?
I've 'sold' this car to guy on a written agreement(stupid me [img]graemlins/banghead.gif[/img] )to take payments on it.
His next payment is due today and the car and him are nowhere to be seen...
I've posted written,signed notice on his front door stating clearly that if he doesnt come up with some cash by midnight tonight or I will start procedings towards either taking the car back or taking legal action...
Now...I'm not looking for people to ask me why I would do such a thing...people have cut me breaks in the past and I was trying to pass it on...I choose the wrong person....
Can someone help me out?

I have a 'contract' of sorts that states that if he doesnt come up with a payment of '$X.00', I will repo the car at no refund to him of any paid monies....with his signature on it...and he has a copy too...
And right now,I need the money worse than I think I have ever needed it....
Anyway...off to bang on his door again and leave another notice...and to see if the car has surfaced...

So here's the deal....
Got ahold of dude and he says the motor puked...his wife was driving the thing downtown and there was this huge billow of blue smoke out the tail and from under the hood....
Noone called me about this.....I live LITERALLY a 2 min walk from their house...They have my phone number,email and work number...I called them about 20 times between Sun. and Mon. to arrange pickup of the next pickup....and until I found him at home tonight right after my last posting,I heard nothing about it...
He now says he has to get the car looked at and an estimate done on how much it will cost to fix...
I need to have the money that was supposed to be his payment in my pocket by Weds. or I am in some very serious **** with alot of people....
I'm so damn stupid for doing a deal like this...People have cut me breaks in the past and I try to help some one just once...and I get bent over for it....
Can anyone offer some advise?
BTW....The bill of sale states "Vehicle sold as is and where is"...I've been told this is a legally standing term...basiclly..Puked engine or not,he still owes me for the balance...Is this correct??

Engine puked or not, it was fine at the time of sale.. if you take out a loan on a house, and it burns down, you can't tell the bank "opps, it burned down.. I don't want it anymore." It's his car, and you have a written aggreement for it. Call him threatening a court case and see if he changes his tune. If he doesnt, file for the smal claims case.. when he gets the summons to appear, he'll change his tune quickly!

That is his next payment....and also how much I need for buying books my first day of school....
I'm going to talk to my boss and see if I can borrow the money from him/the store til friday...Payday!!!.......THANK FRICKIN GOD!!

hey man regardless the money is urs, whether it breaks or not uhave a legal binding contract that he signed agreeing. No if ands or buts he owes u the money i can even find the part in the criminal code if u want lol
