You can try taking this to his watch commander for review. However, I still think that you are fighting a uphill battle. If a officer sees a offense committed, he does not have to ticket you on the spot. If he has identified you to a degree of probability that is in his favour, the ticket is going to stick. I do not think that you will get anywhere with his watch commander at all (especially if this is a long serving member)but is worth it to talk to them. Your best bet here is to talk to the watch commander and ask him/her for their views on the situation as it unfolded from your perspective. If anything, the officer may agree with you and talk to the member under his watch to prevent the situation from happening again.
i've gotten a ticket from not wearing a seat belt before..but i wasn't driving, i was in the back seat. My friend pulls out of the driveway, both of them ofcourse upfront wearing the belts, and we see a police cruiser pulling out of a gas station, and the officer and I made eye contact and there was no "bad look", it was just a casual look as we drove by, and I didnt think much of it. He ended up pulling us over and right then I knew i was screwed. I did have the intention of putting on the seat belt, i just got caught up in a conversation, and basically delayed it till it was too late. I was pissed off, but then again, he's doin his job, sure he was bein an *** about it, while i gave him no attitude, and didn't lie because I knew he saw everything, hoping he may go lightly on me(that's my one and only ticket in 7 years of drivin, and I wasnt even drivin! ). Eventually got a court date, pleaded guilty, and the fine was reduced to 20$ with the lil fee you pay as well.
I guess the point im tryin to get to is, regardless of your intentions (you were gonna put it on, as was I), the time frame that you DIDNT have it on is what the problem is, and pleading guilty would be the best way to get the fine reduced. Would've been nice if the officer was a bit lenient(sp).
